TERMS OF SERVICE

It is your responsibility to thoroughly understand the terms and conditions for the ActifySocial retreat. Please carefully review what is and is not included in your retreat package as outlined on the website. Should you have any questions regarding the terms and conditions, we are available for consultation and would be happy to clarify any areas before signing a contract with us.

PAYMENT TERMS & CANCELLATIONS

1. RETREAT PRICING

All prices are per person and are determined well in advance of the retreat start date. Prices cover retreat costs only; they do not include travel expenses to and from the retreat.

2. RETREAT PAYMENT & DEPOSIT

Payment can be made via credit card, PayPal through the website, or e-transfer. Failure to make full payment by this deadline may result in the cancellation of your reservation, and your spot may be filled. We will make every effort to avoid this situation by contacting you before and on the day of the balance due date.

3. STRICT CANCELLATION POLICY

Cancellation requests must be communicated to ActifySocial via email at hello@actifysocial.com. There are no refunds on deposits. Additionally, no refunds will be issued after the payment deadline specified in section 2 above. Exceptions to our cancellation policy cannot be made for ANY reason, including but not limited to weather, terrorism, civil unrest, health changes, personal emergencies, or other unforeseen circumstances. No refunds will be provided for late arrivals or early departures.

5. TRANSFER POLICY

Reservations cannot be transferred from one retreat to another.

6. RETREAT CANCELLATIONS

ActifySocial reserves the right to make necessary changes, including but not limited to excursions, transportation, and meals. In the event of a retreat cancellation, participants will be offered a transfer to another retreat (if available) or a full refund of their payment. ActifySocial is not liable for any expenses or damages incurred as a result of a retreat cancellation, including preparation costs, airline tickets, travel documents, or other expenses. ActifySocial reserves the right to cancel any retreat before departure if there are too few participants booked, in which case participants will receive a full refund of all payments made to ActifySocial.

8. TRAVEL DOCUMENTS

For retreats held outside North America., all participants passport holders are required to have at least 6 months validity on their passport at the time of travel. Information regarding necessary documentation is provided on our website or can be obtained by contacting us directly.

ROOMMATES

9. ROOMMATE ASSIGNMENTS

Retreat rates are per person. Shared rooms require shared occupancy for the specified room rate. If you book a shared room without specified roommates, we will endeavor to match you with a suitable roommate. If a suitable roommate is unavailable, you will be required to pay the full room cost for a single room rate.

ACKNOWLEDGEMENT

10. ASSUMPTION OF RISK

By participating in this retreat, I acknowledge that I have voluntarily enrolled and agree to release claims, waive liability, and assume all associated risks. I release ActifySocial and its affiliates, instructors, employees, agents, and representatives from any personal injury, death, property damage, or loss suffered during the retreat, regardless of the cause, including negligence.

PHYSICAL TRAINING RELEASE OF LIABILITY

11. EXPRESS ASSUMPTION OF RISK

I am aware of the inherent risks involved in physical training activities and assume full responsibility for any injury or death that may result. I release ActifySocial and its affiliates from any liability arising from my participation in physical training activities, including but not limited to yoga programs.

MEDIA

12. PERMISSION FOR CAPTURE AND USE

I grant ActifySocial permission to use any captured media, including photography, video, or written testimonials, for promotional purposes without restriction. I release ActifySocial from any claims arising from the use of such media.

WAIVER

14. RELEASE AND WAIVER OF LIABILITY

I agree not to make any claims or sue ActifySocial, its affiliates, instructors, employees, or agents for injury or damage resulting from my participation in the retreat. I release ActifySocial from all liability for any injury, damage, or death occurring during the retreat.

I affirm that I am medically, physically, and emotionally fit to participate in the retreat and will follow all safety precautions and instructions provided by ActifySocial. I understand that ActifySocial is not a licensed medical provider and that I must consult my doctor regarding any medical concerns.

I agree to indemnify ActifySocial for any injury or damage caused by my negligence during the retreat.

EVENT WAIVER

ACKNOWLEDGMENT OF RISKS AND RESPONSIBILITIES

Participants of Actify Social experiences and events (hereby referred to as "Participants") must acknowledge the potential risks associated with physical activities, including but not limited to various forms of yoga, meditation, dance, pilates, breath work practice, body massage, and outdoor activities. By attending, Participants understand that participation carries inherent risks to themselves, their pets, family members, guests, and other attendees, including but not limited to physical injury, mental distress, emotional trauma, illness, or property damage.

RELEASE OF LIABILITY

Participants hereby agree to release and hold harmless Actify Social, its owners, directors, managers, employees, affiliates, associates, members, and volunteers (hereinafter collectively referred to as "Releasees") from any and all liability, claims, demands, or causes of action, including those arising from ordinary negligence or inherent risk, associated with participation in the experience or event or use of any Actify Social property. Participants are responsible for any medical or emergency expenses resulting from injury, illness, or other incapacity, regardless of authorization.

RESPONSIBILITY FOR PETS AND EQUIPMENT

If bringing a dog, Participants acknowledge sole responsibility for the dog's behavior and physical control, agreeing to carefully monitor and control it at all times. Participants also acknowledge that Actify Social Headsets are not waterproof and may pose a risk of electrocution.

WAIVER OF CLAIMS

In consideration of participation, Participants release Releasees from present and future claims resulting from ordinary negligence and inherent risk, including but not limited to loss, injury, contamination, damage, or liability to themselves, their pets, or others. Participants attend all sessions and activities accepting and assuming the inherent risks involved.

CONSENT TO USE OF LIKENESS

Additionally, Participants consent to the use of their voice, name, and/or likeness without compensation, in films, pictures, and tapes for exploitation in any and all media, now known or hereafter devised, for eternity. Participants release Actify Social and its successors from any liability arising from such use.

PROPERTY DAMAGE LIABILITY

Participants acknowledge potential liability for damage or loss to Actify Social property and may be charged for the cost of replacement.

ACKNOWLEDGMENT OF TERMS

By acknowledging this release and waiver of liability, Participants fully understand its contents and voluntarily agree to its terms and conditions. Attendance at an Actify Social experience or event constitutes knowing and voluntary acceptance of this waiver and release of liability.
